Abstract: 
There is analyzed the question of the role and place of the constitution in the legitimizing of state power. The conclusion is made that it is in the Constitution as the founding act of the people is laid the foundation of an effective mechanism of legitimation of the government, which includes a system of constitutional principles, guarantees and political means-legal control by the civil society for the public authorities to ensure its legitimacy. Provided that the constitution meets the content of the idea of law, reflects the general social idea of justice, freedom, human rights, it can be considered the starting point of the legitimacy of actions and acts of the government.
